Chapter 7 is the most common type of bankruptcy. Most people continue to drive the same car and live in the same home.  Notwithstanding the 2005 revision of the Federal Bankruptcy Code, relief under Chapter 7 is still available to most citizens.
Chapter 13 is very helpful when the debtor has a substantial amount of equity in a home or business. It will also be more common for families with above average  income, especially since  the  2005  changes  in  the law.    Chapter 13 allows citizens to have a chance to get back on their feet and pay their creditors in  monthly  payments  through  a  reorganization plan over a 36  to  60 month period.
